Terms of Sale

These Terms of Sale (“Terms”) are offered by Killscreen LLC (“Killscreen,” “we,” or “us”) and govern all sales and purchases of any new or refurbished products and services (“Products”) made through killscreen.io or any affiliated webstores. By placing an order, you agree to be bound by these Terms.

1. Scope

The information provided on our website does not constitute an offer for sale but an invitation to treat. A contract forms only once we accept your order. If your order is not accepted and funds have already been deducted, they will be refunded.

2. Orders and Custom Products

• All Killscreen controllers are custom-built or made to order. Once production begins, orders are final and cannot be canceled, modified, or refunded.
• To cancel an order, you must contact us before production begins through our contact form at killscreen.io/contact.
• You must be at least 18 years old and legally capable of entering a binding contract.
• You agree to provide accurate contact and shipping details and are responsible for all applicable taxes or import duties related to your purchase.

3. Product Descriptions and Availability

We make every effort to describe and display our products accurately. However, we do not warrant that descriptions, photographs, or other content are error-free or perfectly color-accurate. Minor color or material variations are not considered defects.

All orders are subject to availability. If an item is unavailable, we may offer a replacement of equal or higher value or issue a full refund. We reserve the right to refuse or cancel any order at our discretion.

4. Pricing and Payment

• All prices are listed in U.S. Dollars unless otherwise stated.
• You agree to pay the listed price and any applicable taxes or import duties.
• Accepted payment methods include major credit/debit cards, PayPal, and Amazon Pay (where available).
• If a pricing or tax error is discovered, we will notify you as soon as possible. If you choose not to proceed at the corrected price, your order will be canceled and refunded.
• By placing an order, you authorize Killscreen to charge your selected payment method for the total amount, including shipping and applicable taxes.
• Chargebacks: You agree not to initiate a chargeback without first contacting Killscreen to attempt to resolve the issue in good faith.

5. Delivery, Risk, and Title

• We ship to the address provided at checkout. Delivery times are estimates and not guarantees.
• Risk of loss passes to you once your package is handed to the carrier.
• Title transfers upon delivery and full payment.
• Refusal of delivery for reasons other than visible shipping damage will be treated as a return under these Terms, and you will be responsible for return shipping and restocking fees.
• If any item is missing or damaged upon delivery, contact us within seven (7) days of receipt via killscreen.io/contact.

6. Returns and Refunds

• Returns are accepted within 30 days of delivery for eligible, unused, and non-custom items only.
• Custom-built controllers are final sale and not eligible for return or refund except in cases of defect or damage upon arrival.
• An up to 15% restocking fee may apply to approved custom returns at Killscreen’s discretion. Additional deductions may apply for signs of use, wear, or missing packaging.
• All returns require prior authorization. Unauthorized returns may be refused or returned to sender, and Killscreen is not responsible for any loss, damage, or delay related to unauthorized returns.
• Original shipping costs are non-refundable. Return shipping costs are the customer’s responsibility unless the product is defective or damaged upon arrival.
• Refunds are processed to the original payment method within 7–10 business days after inspection and approval.
• Non-Refundable Fees: All refunds are subject to deduction of non-refundable payment processing fees charged by our payment processor (typically 3–4 %), which are not returned to us when an order is canceled or refunded. Original shipping costs are also non-refundable.
• Store credit may be offered at Killscreen’s discretion.

7. Warranty

Killscreen products include a 90-day limited warranty covering defects in materials or workmanship under normal use. The warranty does not cover:

• Normal wear and tear
• Accidental or cosmetic damage
• Unauthorized modifications or third-party repairs
• Damage caused by misuse, neglect, or improper handling

8. Limitation of Liability

Killscreen shall not be liable for indirect, incidental, or consequential damages of any kind. Our total liability for any claim shall not exceed the purchase price of the product in question.

9. Privacy and Data

Any personal data collected during your purchase will be processed in accordance with our Privacy Policy. By placing an order, you consent to our use of your information for order processing, shipping, and related communications.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts of Pinellas County, Florida.

11. Entire Agreement

These Terms of Sale, together with our Privacy Policy, represent the entire agreement between you and Killscreen and supersede any prior representations or agreements related to your purchase.
